There are proposed amendments for the Thai Industrial Design Law that will be dropped from the Patent Act and become a separate piece of legislation. This would be done to comply with the ASEAN action plan to become a part of the 1999 Geneva Act also known as the Hague System.
Becoming a part of this Act will aid in streamlining Thai Industrial designs in terms of becoming a “worldwide novelty”, that grants the inventor protection and status. It will transform the registration process from multiple applications to a single one.
The proposed amendments compromise of an extended protection of a total of 15 years that is renewable and that “creativity” must be involved. Though, the creativity aspect has yet to be properly defined it does exclude generic shapes. The absence of creativity with the new Industrial Design Law would mean no protection or recognition from the Department of Intellectual Property.
